The company is the data controller for all data that is considered personal data and is transmitted or uploaded by users when visiting and using the website and when using the services available on the website, as well as all data which the company collects about the user. Personal data is considered any data that can be associated with a specific, i.e. identified or identifiable, natural person (data subject), in particular the name of the data subject, their identification number and one or more pieces of information that are characteristic of their physical, physiological, mental, economic, cultural or social identity, as well as conclusions that can be drawn about the data subject from this information.
This privacy policy applies to personal data provided by users for the proper use of the website or collected by the company about users. If a user voluntarily publishes personal data, this publication is not covered by the privacy policy.
Users decide for themselves whether to provide the data required to use the services available on the website after reading and understanding this privacy policy. 1. General information:
The processing of personal data by the company is subject in particular to the following regulations:
- Act CXII of 2011 (Hungary) on the right to information self-determination and freedom of information (hereinafter: Info Act);
- Act CVIII of 2001 (Hungary) on certain issues of electronic commerce services and services related to the information society (hereinafter: E-com Act);
- Act XLVIII of 2008 (Hungary) on the basic conditions and certain restrictions of economic advertising activities (hereinafter: Ecoadv Act);
- Legal acts of the European Union, insofar as they are directly applicable, in particular Directive 95/45/EC on the protection of individuals with regard to the processing of personal data and on the free movement of such data;
- Recommendations of the Hungarian National Authority for Data Protection and Freedom of Information.
The purpose of this regulation is to set out the data protection and data processing principles applied by IMEX and the IMEX Data Protection and Data Processing Policy, which IMEX recognises as binding on itself. The purpose of this policy is to ensure that, in all areas of the services offered by IMEX, the rights and fundamental freedom of all individuals are protected in relation to the automated processing of their personal data (data protection).
Data security: The company ensures the security of the personal data it manages by implementing appropriate technical and organisational measures and by establishing procedural rules, so that personal data is protected by appropriate measures, in particular against unauthorised access, alteration, disclosure, publication, deletion or accidental destruction. Databases containing personal data are stored in encrypted form, and only those employees of the company who need access to the database for customer service, troubleshooting or advocacy purposes have access to it. In all cases where anonymised data is sufficient to achieve a specific purpose, the company will anonymise the data.

2. Scope of the data processed
When ordering and enquiring about products and services, the following data is processed:

- Email address

- Billing name
- Billing address
- Name for delivery
- Delivery address
- Postal address
The purpose of data processing in relation to the above data is to invoice for the service, collect payment, assist in payment processing and enforce related claims.
Duration of data processing: until the purpose of data processing is achieved or until another time specified by law, i.e. if the company wishes to assert a claim against the user, until the associated legitimate interest exists, or in relation to data listed in the accounting documents (invoices) associated with the service (invoice name, address and service ordered as specified by the user) and the data required to substantiate this information in accordance with accounting regulations, in accordance with Hungarian Act C of 2000 on accounting, for a period of 8 years from the date of creation of the data, whereby this data processing is mandatory.

3. Legal basis, purpose and nature of data processing:
The legal basis for data processing is that, pursuant to Section 5 (1) a) of Hungarian Act CXII of 2011 on the right to self-determination and freedom of information, personal data may be processed if the data subject has given their consent.
The purpose of data processing is to provide the services available at the URLs http://imex.filtertechnika.hu and https://www.IMEXshop.hu/ and their language versions.
The purpose of the automatically collected data is to provide the services accessible via the IMEX website, to display personalised content and advertising, to compile statistics, to further develop the IT system and to protect the rights of users.
The data controller may not use the personal data provided for purposes other than those specified in these points. Unless otherwise prescribed by law, personal data may only be disclosed to third parties or authorities with the prior express consent of the user.
The data controller does not verify the personal data provided to it. The person who submitted the data is solely responsible for the accuracy of the data submitted. By providing their email address, each user assumes responsibility for ensuring that only they themselves use the services via the email address provided. In view of this responsibility, the user who provided the email address is solely responsible for all access via this email address.

4. Principles of data processing:
Personal data may only be stored for specific and lawful purposes and may not be used for other purposes.
Personal data must be proportionate to the purpose of its storage and must correspond to this purpose without exceeding it.
The manner in which personal data is stored must be such that the data subject can only be identified for as long as is necessary for the purpose of storage.
Appropriate security measures must be taken to protect personal data in automated files from accidental or unlawful destruction, accidental loss, unlawful access, alteration or dissemination.

5. Data protection guidelines applied by IMEX:
As a data processor, IMEX undertakes to treat the personal data in its possession in accordance with the provisions of the Info Act and the data protection principles set out in this policy and not to pass it on to third parties. With regard to data transfer, the provisions contained in this section constitute an exception for data that the user provides when making purchases on http://imex.filtertechnika.hu and https://www.imexshop.hu webpages, which is forwarded to the seller, as well as the use of data in statistically aggregated form, which must not contain the name of the user concerned or any other data that could be used for identification purposes.
In certain cases – in the event of official requests from courts or police authorities, in legal proceedings for copyright, property or other infringements, or in the event of reasonable suspicion of such infringements that harm the interests of IMEX or jeopardise the provision of its services, etc. – IMEX will make the available data of the user concerned accessible to third parties.
In all cases where IMEX wishes to use the personal data provided for a purpose other than the original purpose of data collection, it shall inform the user thereof and obtain their prior express consent or give them the opportunity to prohibit such use.
As a data processor, IMEX complies with the restrictions laid down by law when collecting, storing and processing data and, at the request of the data subject, informs them by email about its activities. IMEX undertakes not to impose any sanctions on users who refuse to provide data voluntarily.
IMEX Filtertechnika undertakes to ensure the security of personal data, to take the technical and organisational measures and to establish the procedural rules that guarantee that the personal data collected, stored and processed is protected and that its destruction, unauthorised use and unauthorised modification are prevented. It also undertakes to require all third parties to whom it forwards or transfers personal data to fulfil these obligations.

6. Rights of the user with regard to data processing by the company:
In accordance with Sections 14-18 of the Info. Act, the data subject (the user) has the right to request information about the processing of their personal data managed by the company, to request its correction, and to request its deletion or blocking. The user has the right to prohibit data processing based on their voluntary consent and independent of the conclusion and performance of the service contract.
The user may at any time request information about data processing by the service provider, in particular about the purpose of data processing, the legal basis or the identity of the data processor. The company is obliged to provide the information in writing in an understandable form as soon as possible, but no later than 25 days after the request is submitted. The user may request information about data processing once a year free of charge. If the data subject requests information about the same data area again in the same year, the company is entitled to demand reimbursement of costs. The costs already paid by the user will be reimbursed by the company to the user if the user's personal data is corrected or deleted or if this is necessary in accordance with the Info. Act. If the company considers the request to be unfounded and refuses to comply with it, it shall inform the data subject in writing on the basis of which provision of this Act the information was refused. In the event of a refusal to provide information, the company shall inform the data subject of the possibility of seeking legal redress in court and of the possibility of contacting the authority.
The user may request the correction of their data if they are not true.
The company shall delete the user's personal data if:
- the data processing is unlawful;
- the user requests the deletion of the data;
- the user's personal data is incomplete or incorrect and this situation cannot be remedied lawfully, unless deletion is excluded by law;
- the purpose of the data processing has ceased to exist;
- this has been ordered by a court or the Hungarian National Authority for Data Protection and Freedom of Information.
The user's request for deletion may only relate to the deletion of data processed with their consent and has no influence on the scope of data whose processing is required by law. The company is also entitled to process data without consent or after a request for withdrawal of consent in accordance with Section 6 of the Info. Act, provided that this is necessary to fulfil the company's legal obligations as a data processor or to enforce the company's legitimate interests and there are no circumstances in which the data subject's right to protection of their personal data outweighs the company's interest in data processing.
Instead of deletion, the user may request the blocking of their personal data. In the event of data blocking, the user's personal data will be marked with a label that restricts further processing of the data for an indefinite or specific period of time.
Requests under this point will be accepted by the company via the customer service contact details.
The user may also object to the processing of their personal data if the processing or transfer of the personal data is necessary solely for the fulfilment of a legal obligation of the data processor or for the protection of the legitimate interests of the data processor or a third party (except in the case of mandatory data processing) or if the use or transfer of the personal data is for the purpose of direct customer advertising, opinion polls or scientific research. The company will review the objection as soon as possible after the request is submitted, but no later than within 15 days, and will inform the user in writing of its decision regarding the validity of the objection. If the company determines that the user's objection is justified, it will cease processing the data, block the data and inform all persons to whom the data affected by the objection has been disclosed and who are obliged to take measures to enforce the right to object about the objection and the measures taken as a result.

7. Duration of data processing:
Issued invoices must be retained for 8 years from the date of invoicing in accordance with Section 169(2) of the Hungarian Accounting Act. Please note that, in accordance with Section 6 (5) a) of the Info. Act, the data processor is entitled to retain your personal data collected during invoicing for 8 years if you revoke your consent to invoicing. IMEX ensures that this automatically collected data cannot be linked to other personal data of the user, except in cases required by law. If the user has withdrawn their consent to the processing of their personal data or has unsubscribed from the service, they can no longer be identified on the basis of the technical data.

8. Handling of personal data:
When using the web services offered by IMEX (raffles, newsletters, etc.), IMEX uses the personal data provided by the user and the data related to the individual use of the services (log files, click behaviour, searched items) for the specified purpose and, until the user revokes their consent, to inform the user individually about IMEX's range of products and services on the basis of this data. The user can revoke this consent at any time by sending a corresponding message to the following address: info@Imex.filtertechnika.hu.
Changes to the user's personal data can be requested via the settings in the user interface on the website or by contacting customer service. Users can unsubscribe from newsletters at the end of each newsletter or by contacting customer service.

9. Possibility of data transfer:
IMEX reserves the right to transfer stored data between members of the group of companies in the event of a legitimate interest.
As a data processor, IMEX is entitled and obliged to pass on all personal data available to it and duly stored by it to the competent authorities if it is obliged to transfer data by law or by legally binding official orders. The data processor cannot be held liable for such data transfer and the resulting consequences.
If IMEX transfers the operation or use of the content on the website in whole or in part to third parties, it may pass on the personal data it manages to these third parties for further processing without separate consent. This data transfer may only serve to maintain the registration of already registered users, but may not place the user in a less favourable position than the rules on data processing and data security set out in the currently valid version of this privacy policy.
For the purpose of verifying the lawfulness of the data transfer and informing the data subject, IMEX maintains a data transfer register containing the time of transfer of the personal data it processes, the legal basis and recipient of the data transfer, the determination of the scope of the personal data transferred, and other data specified in the data processing legislation.

10. Handling of cookies:
By visiting our websites, the visitor agrees – depending on the cookie settings – that their data will be passed on to the above-mentioned service providers in compliance with the applicable legal provisions (consent to data processing).

10.1. What are cookies?
When visitors visit the pages https://imex.filtertechnika.hu and https://www.imexshop.hu, a small file, known as a "cookie" (hereinafter: "cookie"), is stored on their computer, which can serve various purposes. Some of the cookies being used are essential for the proper functioning of the website ("process cookies"), while others collect information about the use of the website (statistics) in order to make the website even more convenient and useful. Some "cookies" are temporary and disappear when you close your browser, while others are permanent and remain on your computer for a longer period of time.

10.2. Purpose of cookies

10.3.2. "Usage support cookies"
These cookies enable our website to remember which operating mode you have selected (e.g. whether you are using the Hungarian, German or English version of the website, whether you have selected the accessible version, how many hits should be displayed in the search results list at the same time, etc.). This is done so that the user does not have to re-enter this information on the next visit. 11. Changes to the privacy policy:
IMEX reserves the right to unilaterally amend this privacy policy at any time in accordance with the Info. Act. Following an amendment to the privacy policy, all users must be informed in an appropriate manner (via newsletter, pop-up window when logging in, e-mail system message). 12. Data processing in connection with customer service and complaints:

When investigating complaints submitted by consumers, the processing of the data listed below is mandatory in accordance with Section 17/A of the Hungarian Consumer Protection Act (CLV) of 1997. In all other cases, the use of customer service is voluntary and based on the user's voluntary consent:

The purpose of processing the data provided when contacting customer service is to respond to, investigate and process the complaint or question raised in the report and to inform the user of the company's factual response.

15. Legal remedy:
In the event of a violation of their rights, the data subject is entitled to lodge a complaint with the Hungarian National Authority for Data Protection and Freedom of Information (address: 1125 Budapest, Szilágyi Erzsébet fasor 22/c; telephone: +36-1-391-1400; email: ugyfelszolgalat@naih.hu) or, at their discretion, to the court at the company's registered office or at the place of residence or domicile of the data subject.
If the company rejects the user's request, the user may file a report with the Hungarian National Authority for Data Protection and Freedom of Information or contact the court at their place of residence or place of stay. If the user does not agree with the company's decision on their objection or if the company does not make a decision within the deadline, the user may apply to the court of their place of residence or domicile within 30 days of the decision being announced or after the deadline has expired.
